Filing Bankruptcy Stops Creditors and Discharges Debt

As soon as you file for Chapter 7 or Chapter 13 bankruptcy there is an automatic stay of collection actions.  This stops creditors from continuing with collection activities.   In a Chapter 7 most debts with the exception of special debts such as child support and court fines are discharged and you no longer have to pay them.   In a Chapter 13 some of your debts are paid in part and discharged, and some are paid in full through the Chapter 13 plan.  Chapter 7 is generally the simpler, less expensive and faster choice.   Many people with too much debt qualify for a Chapter 7.  However, in some cases Chapter 13 is occasionally a good option.  Consulting with a bankruptcy lawyer can you help get the information you need to know about Chapter 7 or Chapter 13.
